"On May 13, 2025, the European Union published Regulation No. 2025/877 (Omnibus VII) in the Official Journal of the EU, amending Regulation (EC) No. 1223/2009 on cosmetic products. The amendment adds substances classified as carcinogenic, mutagenic, or toxic for reproduction (CMR) under Commission Delegated Regulation (EU) 2024/197 to Annex II of Regulation (EC) No. 1223/2009, thereby prohibiting their use in cosmetic products. The regulation will apply from September 1, 2025, and products that do not comply will no longer be allowed to be placed or made available on the market after this date. The harmonized classification of substances as CMR is provided under Regulation (EC) No 1272/2008, based on assessments by the Committee for Risk Assessment of the European Chemicals Agency. CMR substances are categorized as 1A, 1B, or 2, depending on the evidence of their hazardous properties. Article 15 of Regulation (EC) No 1223/2009 prohibits the use of CMR substances in cosmetics unless specific conditions for exemption are met. However, no application for derogation has been made for any of the substances concerned in this regulation. To ensure consistent application of the ban across the EU and enhance legal clarity and health protection, all newly classified CMR substances are being added to Annex II of Regulation (EC) No. 1223/2009. Where appropriate, substances are also removed from Annexes III to VI, which cover restricted or permitted substances. Notably, the substance ‘diphenyl(2,4,6-trimethylbenzoyl)phosphine oxide’ (CAS No 75980-60-8), known as Trimethylbenzoyl Diphenylphosphine Oxide, previously authorized under entry 311 of Annex III for use in artificial nail preparations up to 5%, is now classified as a CMR category 1B substance and thus prohibited. As a result, entry 311 in Annex III is deleted, and the substance is added to Annex II. Additionally, entry 1580 of Annex II, concerning ‘cymoxanil’ (CAS 57966-95-7), classified as a reproductive toxicant category 2, is updated to include its alternative chemical name ‘(2E)-2-cyano-N-[(ethylamino)carbonyl]-2-(methoxyimino)acetamide’ and its corresponding CAS number 166900-80-7, to ensure consistency with Regulation (EC) No 1272/2008.
