On February 20, 2026, the United States Environmental Protection Agency (EPA) published a final rule amending pesticide tolerances under the Federal Food, Drug, and Cosmetic Act (FFDCA). The rule implements tolerance actions identified during registration review under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA).
The final rule confirms previously proposed tolerance modifications (published May 22, 2025) without changes. The actions apply to the following pesticide active ingredients: diphenylamine, diflubenzuron, flutolanil, isoxaflutole, famoxadone, aminopyralid, fenazaquin, and tembotrione.
EPA finalized revisions to maximum residue limits (tolerances) in or on various agricultural commodities, including fruits, vegetables, grains, oilseeds, livestock commodities, and processed products. In certain cases, tolerances were revised, added, or revoked to align with updated safety assessments conducted during registration review.
The rule is effective February 20, 2026. Objections and requests for hearings must be submitted by April 21, 2026, in accordance with 40 CFR Part 178 procedures. For tolerances that are lowered or revoked, EPA established a six-month expiration period to allow exporting countries to adjust to the new requirements, consistent with WTO SPS considerations.
