The European Union has proposed a draft Delegated Regulation to amend Regulation (EU) 2016/127, updating protein-related requirements for infant and follow-on formula made from protein hydrolysates. The notification was circulated to the WTO on 16 July 2025, with comments open until 14 September 2025.
Key highlights: Scientific Basis: The amendment follows an EFSA opinion (Nov 2024) confirming the nutritional safety and suitability of a new protein hydrolysate developed by Fonterra Co-operative Group Ltd.
Regulatory Update: The proposed change will allow the market placement of infant and follow-on formulae using this newly assessed protein source, which previously did not meet the compositional criteria under Regulation (EU) 2016/127.
Scope: Applies to all food products under the EU’s infant nutrition category.
Objective: To ensure consumer safety while enabling innovation in infant formula manufacturing.
Adoption Timeline: Expected in Q1 2026, with entry into force upon publication in the Official Journal of the EU.
This move reflects the EU’s commitment to science-based regulation and supports the development of safe, alternative protein sources for infant nutrition.
