The United States Environmental Protection Agency issued a final rule on 27 February 2026 amending 40 CFR Part 372 to update the Toxics Release Inventory (TRI) chemical list. The rule implements a statutory requirement under the National Defense Authorization Act for Fiscal Year 2020 to add one per- and polyfluoroalkyl substance (PFAS) to the reporting list under the Emergency Planning and Community Right-to-Know Act and the Pollution Prevention Act.

The update ensures that facilities manufacturing, processing, or otherwise using the specified PFAS must report environmental releases and waste management information through the TRI program. Because the addition is mandated by Congress, the EPA issued the rule without notice-and-comment rulemaking.
