On 12 January 2026, the European Commission (EC) adopted Regulation (EU) 2026/78, amending the EU Cosmetics Regulation (Regulation (EC) No 1223/2009) to strengthen safety rules for cosmetic products containing carcinogenic, mutagenic, or toxic for reproduction (CMR) substances. This amendment aligns cosmetic-sector regulations with the latest EU hazard classifications under the Classification, Labelling and Packaging (CLP) Regulation, particularly those newly included in Commission Delegated Regulation (EU) 2024/2564.

The Regulation updates Annex II by reorganising prohibited substances and explicitly banning CMR chemicals such as N,N’-methylenediacrylamide and sodium 3-(allyloxy)-2-hydroxypropanesulphonate. It also revises Annex III, establishing precise use conditions and maximum concentration limits for other CMR-classified ingredients, including hexyl salicylate, tailored by product type—covering fragrances, rinse-off, leave-on, and children’s cosmetics—to ensure consumer safety.

Published in the Official Journal L on 13 January 2026, the Regulation is directly applicable from 1 May 2026 across all EU Member States, ensuring harmonized safety standards and enhanced protection against harmful chemical exposure in cosmetics.
