Health Canada has finalized a ministerial class exemption order to allow the exceptional importation and sale of certain foods for special dietary purposes (FSDP) in response to shortages or risks of shortages .
Purpose: To replace the interim policy introduced during infant formula shortages, enabling faster access to essential dietary products like infant formula, human milk fortifiers, and foods for inborn errors of metabolism.

It establishes a framework for importing foreign-made or domestically produced FSDPs authorized in designated jurisdictions with acceptable safety standards.
It also mentions supports continued market access for products under Health Canada’s Transition Strategy, ensuring availability post-expiration of the interim policy.
Exemptions Include:
Labelling, compositional, and pre-market review exemptions for eligible products.
International Alignment: Imports must originate from jurisdictions with comparable food safety and quality standards.
